General Terms and Conditions
1. Scope
1.1 These General Terms and Conditions (the "GTC") govern the relationship between Capriotti ("Capriotti", "we" or "us") and its guests and users of the website www.capriotti.ch.
1.2 These GTC apply to all reservations, orders and services in the restaurant and bar, the purchase of vouchers and the use of our website.
1.3 By reserving a table, ordering food or beverages, purchasing a voucher or using our website, you accept these GTC.
1.4 Any differing or conflicting terms of a guest apply only if we have expressly agreed to them in writing. Supplementary or differing written agreements may be made for group bookings, exclusive events and catering; such agreements take precedence over these GTC.

3. Services and Opening Hours
3.1 Capriotti operates a restaurant and bar in St. Gallen, serving food and beverages for consumption on the premises. Vouchers, group events and exclusive bookings may also be offered.
3.2 Current opening hours are published on our website. We expressly reserve the right to vary them on public holidays, during annual closures, for private events or for operational reasons.
3.3 Our food and beverage offering may be changed at any time. Individual items may be temporarily unavailable. There is no entitlement to any particular dish, beverage or table.
4. Table reservations
4.1 Reservations can be made by telephone, email or using the reservation tool on our website. A reservation becomes binding only when we have confirmed it, whether verbally, by email or through the reservation system's automatic confirmation.
4.2 The reserved table will be available from the agreed time. We endeavour to accommodate seating requests but cannot guarantee them.
4.3 During periods of high demand, reservations may be assigned a limited seating time. If so, the available time will be stated in the reservation confirmation.
4.4 If the number of guests changes, please let us know as early as possible. If your group is significantly larger than reserved, we cannot guarantee additional seats.
5. Late Arrivals and No-Shows
5.1 Reserved tables will be held for up to [15] minutes after the agreed time. We may then reassign the table unless you have informed us that you will be late.
5.2 Please cancel as early as possible by telephone, email or using the link in the reservation confirmation.
5.3 For reservations of [8] or more guests, we reserve the right to charge a no-show fee of CHF [30] for each guest who does not attend if the reservation is not cancelled in time or in the event of a no-show. A cancellation is considered timely if we receive it at least [48] hours before the reserved time. This policy is expressly stated in the reservation confirmation.
5.4 The conditions set out in section 6 apply to groups with a pre-ordered menu, exclusive bookings and events.
6. Groups, Private Parties and Exclusive Events
6.1 For groups of [12] or more, a menu pre-order may be required. The menu selection must be provided no later than [7] days before the event.
6.2 The final number of attendees must be provided no later than [72] hours before the event. This number will form the basis for invoicing. If fewer people attend, the number reported will be charged. Additional guests will be accommodated where possible and charged accordingly.
6.3 If a confirmed group booking or exclusive event is cancelled, the following charges apply as a percentage of the agreed amount unless otherwise agreed in writing:

[13] to [7] days before the event: [30]%

[6] to [2] days before the event: [50]%

less than [48] hours before the event or in the event of a no-show: [100]%
6.4 For exclusive bookings of the entire venue or individual areas, a minimum spend and a deposit may be agreed. The deposit will be credited against the final invoice.
6.5 Guests may not bring their own food or beverages. Exceptions, such as cakes for special occasions, require prior agreement and may be subject to a service charge.
7. Food, Beverages and Allergens
7.1 Our food and beverages are freshly prepared. Minor variations in ingredients, preparation and presentation compared with images and descriptions are possible.
7.2 On request, our service staff will provide information about ingredients and substances that may cause allergies or intolerances in accordance with food-law requirements. Please inform us of any allergies or intolerances before ordering and, for group bookings, where possible when making the reservation.
7.3 A wide variety of ingredients is processed in our kitchen. Despite careful working practices, traces of individual allergens cannot be completely excluded. We therefore cannot guarantee that dishes are entirely free from particular substances.
8. Prices, Payment and Invoicing

9. Vouchers
9.1 Capriotti vouchers can be purchased in the restaurant and, if offered, via our website.
9.2 Vouchers are valid for 2 years from the date of issue and can be redeemed at Capriotti. They are transferable.
9.3 Vouchers cannot be redeemed for cash. Any remaining balance will remain on the voucher and can be used on a future visit.
9.4 In case of loss, theft, or damage to a voucher, there is no entitlement to a replacement. For vouchers purchased via our website, we will consider reissuing them, provided the transaction can be clearly identified and the voucher has not yet been redeemed.
9.5 Vouchers may not be resold commercially or used for advertising purposes without our written consent.
10. House Rules and Right of Admission
10.1 Capriotti exercises its right to enforce house rules throughout the premises. Guests must follow the instructions of our staff.
10.2 We reserve the right to refuse entry to or remove from the premises anyone who harasses other guests or staff, disrupts operations, breaches the house rules or is heavily intoxicated. Any goods and services already consumed must be paid for in all cases.
10.3 Smoking is prohibited throughout all indoor areas in accordance with statutory requirements. This also applies to e-cigarettes and similar products.
10.4 Guests may not bring their own food or beverages.
10.5 Dogs and other pets are permitted only by prior arrangement and when accompanied.
10.6 Any damage to furniture, tableware, fixtures or the building caused intentionally or negligently must be paid for.
11. Protection of Minors and Alcohol Service

12. Photography and Audio/Video Recordings
12.1 Private recordings are permitted provided they do not infringe the personal rights of other guests or staff and do not disrupt operations.
12.2 Recordings for commercial purposes, the press, advertising or editorial content require our prior consent.
12.3 At public occasions and events, we or third parties commissioned by us may take photographs and videos for documentation and advertising purposes. If you do not agree, you can inform our staff on site or contact us afterwards at info@capriotti.ch ; we will remove the relevant recordings from our channels.
13. Cloakroom, Valuables and Lost Property
13.1 Cloakroom areas are provided without supervision and are used at your own risk. To the extent permitted by law, we accept no liability for lost or damaged clothing or other items.
13.2 We recommend keeping valuables with you at all times.
13.3 Lost property is kept for 7 days and may be collected during opening hours. After that, it will be handed over to a lost-property office or disposed of.
14. Liability
14.1 We are liable for damage caused intentionally or through gross negligence by us or our auxiliary persons, and for personal injury to the extent required by law.
14.2 In all other respects, liability is excluded to the extent permitted by law. This applies in particular to slight negligence, indirect damage, consequential damage and loss of profit.
14.3 We accept no liability for damage caused by failure to follow staff instructions, the conduct of other guests or force majeure.
14.4 Guests use our premises at their own risk. We are not liable for items brought onto the premises or for vehicles parked nearby.
14.5 If we are unable to honour a confirmed reservation or event for reasons beyond our control, such as official orders, operational disruptions, illness within the team, infrastructure failure or force majeure, we will inform you as soon as possible. Any deposits already paid will be refunded. No further claims may be made.
15. Defects and Complaints
15.1 Complaints about food, beverages or service must be reported to our staff immediately on site. Only then can we resolve the matter promptly.
15.2 Complaints made at a later date cannot be considered if they were not first reported on site.
16. Use of the Website
16.1 We endeavour to keep the content of our website current and accurate. We give no warranty as to its completeness, accuracy or timeliness, particularly with regard to menus, prices and opening hours.
16.2 All website content, particularly text, images, graphics, logos and design elements, is protected by copyright. Any use beyond what is permitted by law requires our prior written consent.
16.3 Our website may contain links to third-party websites. We have no control over their content and accept no liability for it.
16.4 There is no entitlement to uninterrupted availability of the website or reservation system. Interruptions for maintenance or technical reasons are reserved.
17. Data Protection

19. Applicable Law and Jurisdiction
19.1 All legal relationships between Capriotti and its guests or users of the website are governed exclusively by Swiss law, excluding the conflict-of-law rules of private international law and the United Nations Convention on Contracts for the International Sale of Goods.
19.2 The exclusive place of jurisdiction is St. Gallen, Switzerland. Mandatory statutory jurisdictions remain reserved.
20. Final Provisions
20.1 Should individual provisions of these Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the original provision.
20.2 Amendments and additions to agreements with Capriotti require written form to be valid. This also applies to the waiver of this written form requirement.
